Now open, until 2pm of next Monday (06/04), the online registration for participation in Auction Transmission No. 05/2012, at the website of the National Energy Agency (ANEEL). The guarantee contribution of 1% of the investment value estimated by ANEEL is now also available at the website of ANEEL, until 4pm on Monday (06/04).

The delivery of securities to be held on Monday until 4pm will happen at the BM&FBOVESPA, for those without digital certification, and at ANEEL, in regard to those with escrow account. On Tuesday, 06/05, the Special Procurement Committee (CEL) will announce the bidders who will participate in the auction.

Six lines and six substations will be auctioned in the states of Rio Grande do Sul, Paraná, Mato Grosso do Sul, Minas Gerais and Bahia. The Maximum Annual Revenue Allowed (RAP)* to be paid to entrepreneurs, given the tender document, is BRL 99.9 million. Winners will be the tenderers submitting the lowest value of RAP per lot.

For being a work for the 2014 World Cup, with completion period reduced, the D Lot of Transmission Auction No. 03/2012, without interested parties at the event held last April, returns as the F Lot of Auction No. 05/2012. A Revaluation was performed related to the percentage change of the type of structures (towers), the result of technical analysis of the regions which the given transmission line goes through, close to areas of urban expansion, with Forest and Cerrado biomes.

Systematics of the auction – this auction, the practice of submitting a proposal returns with the financial value of the RAP for each lot during the auction in a sealed envelope. All applicants registered and qualified to compete in the lot must submit a proposal to the auctioneer at the time of the event, including those who may have lost interest in the dispute – in this case they should put an envelope in the form of refusal to tender. If the difference between the lowest bid and other bids is greater than 5%, the lowest bidder wins the tender. If the difference is less than or equal to 5% or if there is a tie among the lowest bids, there will be round speakerphone, in which the auctioneer may set minimum values ​​to be provided between a bid and others. The winner of the bidder will be that submitting the lowest value. In case of any bidder to bid on speakerphone, they winner will be that submitting the lowest value per envelope. If there is a tie in values ​​reported by submission of envelope without speakerphone bids, the winner will be determined by a drawing promoted by the director of the session. To promote the competition, there might be an exclusion of a lot to which there is only one bidder able to compete after manifestation of the Ministry of Mines and Energy (MME). If the lot is maintained, it will be adopted for a Recipe Book value less than the maximum RAP also fixed in the Invitation, as a way to get a minimum discount.

Guarantees – To participate in the auction, bidders must have given a guarantee of up to 1% of the investment value estimated by ANEEL, with extension period of 60 days. The Performance Bond is provided only by the winners of the auction, instead of the foregoing guarantee. It corresponds to 5% of the investment value and should be given within two business days before signing the contract.

Schedule – According to the schedule of the announcement, winning bidders must submit the documents for the qualification phase on 06/15, at the BM&FBovespa. Until 06/22, the Special Licensing Committee (CEL) of ANEEL will disclose the results of the qualification. The result of the approval and award of the concession are scheduled for 07/03. The deadline for delivery on schedule and on budget construction of the facility is 07/16, when it should also be given the documents of the SPE or of the transmission concessionaire required for the concession contract. Two days before the date to be set for signing the concession contract, entrepreneurs must submit a performance bond. The contracts must be signed within 14 days from the date of convocation.

Change – The methodology for Transmission Auction No. 05/2012 will be the same as that of Transmission Auction No. 02/2012, held in April. They will return the delivery of bid proposal envelopes during the event and also the Reserve Revenue, which is the maximum amount of RAP to be hired for a specific lot, corresponding to 95% of the maximum RAP, if there is a single bidder for the lot. From Transmission Auction No. 03/2012, we maintained the extension period of guarantee for participation in the auction, which is 60 days.

* Annual Revenue Allowed (RAP) – it is the annual revenue that the transmitter shall be entitled for the provision of public transmission service to users from the commercial operation of the facilities. Its value is that obtained as a result of the auction, with annual update of the Consumer Price Index (IPCA) of the Brazilian Institute of Geography and Statistics (IBGE) and revision every five years under the concession contract.
