The collegiate board of the Brazilian Electricity Regulatory Agency (ANEEL) approved a public hearing to get contributions regarding the procedures and conditions for providing accessory activities by the distributors as well as for charging for third party products and services through the electricity bill.
The subject will be in hearing from 6/28 to 9/25 with ten physical presence sessions in the following capitals: Belém, Salvador, Fortaleza, São Paulo, Rio de Janeiro, Belo Horizonte, Cuiabá, Brasília, Florianópolis and Porto Alegre. The dates and locations of the sessions will be released later on the ANEEL website. These sessions will take place on the same dates and places of the hearing to discuss regulation of prepayment for energy.
The draft of the hearing resolution shows the following highlights:
– The accessory and atypical activities offered can only be provided or charged in the bill if there is a formal request or agreement by the owner of the consumer unit. This should be done in written form or another method that can be proved and audited later.
– The consumer shall not have electricity supply suspended by virtue of any compromising of payment capacity related to third party services or products. Thus, the existence of a separate barcode or other means that permits the option of nonpayment of other charges on the bill is proposed, without resulting in suspension.
– If the consumer defaults, the charging of a fine or late payment interest for services or products related to the accessory or atypical activities shall observe the specific contract conditions established with the consumer, that is, default does not result in the automatic application of the same fine or interest rate stipulated in art. 126 of Normative Resolution no. 414/2010.
– Undue charges shall be reimbursed in double.
– The distributor will be prohibited to make shared use – with third parties responsible for providing services or selling of products – of human resources, materials and installations.
– In the case of receiving complaints or requests for information related to the providing of a service or product by a third party, the consumer will be directed to the service center provided by the third party responsible.
