Regulation on dismissing CCEE agents is in public hearing

The period for sending contributions to public hearing no. 049/2012 aimed at gathering subsidies to improve the normative resolution that establishes conditions for dismissing agents in default that are members of the Electric Energy Commercialization Chamber (CCEE) begins today (6/28).

The resolution will all regulate the possibilities for impugnation, before the Agency, of acts practiced within the ambit of the CCEE and the procedures for dismissal that should be included in the Commercialization Procedure (CP).

As per the standard's proposal, the procedure for dismissal will be filed and conducted by the CCEE, with the agent ensured the right to appeal and to ample defense.The dismissal of a CCEE agent motivated by default results from noncompliance with obligations established by the standards in effect, including, the Commercialization Convention, the Commercialization Rules and Procedures and the CCEE Bylaws.

In relation to the resources against CCEE acts, the proposed resolution foresees the filing of an appeal with the ANEEL Collegiate Board of those decisions pronounced within the ambit of the CCEE, in a single or final instance, when contrary to those standard provisions currently in effect.

The resolution proposal characterizes the possibility of dismissal of a CCEE agent due to default as an infraction subject to the penalty of revocation of authorization.
