The board of directors of the Brazilian Electricity Regulatory Agency (Agência Nacional de Energia Elétrica – ANEEL) approved the public hearing to improve the proposal of the Contract of Physical Energy and Power Collateral of Quotas to be signed by the generation concessionaires that had their concessions extended according to the conditions established in Provisional Measure 579/2012 and by the electricity distributor of the National Interconnected System (Sistema Interligado Nacional – SIN).
Decree 7805/12 defined ANEEL’s competency to elaborate the quota contract that among various aspects should contain: full allocation of physical collateral for energy and power of generating plants; the amount to be considered as ballast for contractual coverage of distributors is 95% of the quotas allocated and the means of bilateral billing between distributors and generators.
According to the proposal at the hearing, each agent will be signing the respective contract of adherence to quotas, whose final term will be coincident with the final expiration of the term of the concession granted to the generator. During the public meeting held today (10/09) which decided that the opening of the hearing, ANEEL’s board of directors also suggested the possibility of the contractual relationship being established without any formalization of the quota contract.
The hearing will be started next Thursday (10/11) and will receive contributions until October 21 of this year.
