Companies are suspended from executing penalties during intervention

The board of directors of the Brazilian Electricity Regulatory Agency (ANEEL – Agência Nacional de Energia Elétrica) determined on this Tuesday (05/15), during the Public meeting, the suspension of demand of fines that transited on trial before or during the intervention determined by the Agency to companies of the Grupo Rede (Enersul, Caiuá Distribuição de Energia S.A. – Caiuá, Companhia Nacional de Energia Elétrica – CNEE, Companhia Força e Luz do Oeste – CFLO, Empresa de Distribuição de Energia Vale Paranapanema S.A. – EDEVP, Empresa Elétrica Bragantina S.A. – EEB, Companhia de Energia Elétrica do Estado do Tocantins – Celtins – and Centrais Elétricas Matogrossenses S.A. – Cemat).

The suspension, however, does not require the interruption of ongoing punitive processes, which may be deliberated, since they contain the disposition that the fines will only be settled after the intervention. The measure meets the request made by the eight companies to suspend penalties due to financial difficulties faced by Grupo Rede. The Agency, however, denied the request for non-payment of compensation for breach of quality indicators. (PG/DB)
