The Board of the National Agency of Electricity (ANEEL) approved the result of the Public Audience No. 57/2012, which discussed general procedures for the requirement of a declaration of public utility (DPU), for purposes of expropriation and imposition of easements for areas of land required for the implementation of the generation, transmission and distribution by dealers and authorized ones.
According to the draft resolution adopted, in addition to meeting the requirements of the Normative Resolution No. 279/2007, the interested parties should comply with the following: identification of the area of land to be subject to expropriation or servitude, analysis methodology for the evaluation of the areas of land, improvements and damages and proof of application for a permit the installation of electric power from the agency competent environmental.
The Hydroelectric Company of San Francisco (Chesf) had requested that ANEEL issue the DUP automatically after the publication of the granting or the signing of the concession agreement, without the necessity of complying with the requirements established in Normative Resolution. 279/2007. However, the Agency found that the automatic issue of DUP counter to the objective of the agents concentrate efforts to obtain the land through friendly negotiation with owners.
