On Tuesday (07/09) the Board of ANEEL approved the criteria for disregarding the obligation of including the implementation schedule for generating projects related to authorization acts. According to the approved standard, the company must comply with the 36-month deadline for the commercial operation of the project. The standard will be applied to plants that meet the following cumulative criteria: plants which are thermoelectric, self-producer or independent producers, aimed at supplying the Free Contracting Environment (ACL) and are connected to the distribution network or stand-alone operation.
Failure to comply with the deadline to start commercial operation will result in sanctions, unless the delay is due to acts performed by the Government, unforeseeable circumstances or force majeure. Generation agents listed by the standard should express interest by maintaining their projects within 30 days from the publication of the resolution, and if there is no manifestation, the granting act may be revoked.
