At a meeting held Tuesday, the Board of ANEEL decided to close Public Hearing 122/2010, set to discuss the proposed standard regarding the recomposition of the energy and power ballast in situations reached by legal, administrative or arbitrational measures. The preparation of a new draft regulation on the matter, within 120 days, was also determined.
On the vote, the Chief Rapporteur, Julian Silveira Coelho, said that the proposed regulation originally presented at the hearing should be improved with regard to the scope of the standard, the requirement of a security deposit, and the operationalization of the retroactive ballast recomposition mechanism. The objective is to match the mechanism with the calculation methodology of financial guarantees, the institution of sale agreement registration effectuation, and application of Normative Resolutions 437/2011, 531/2012, and 545/2013.
