The Brazilian Electricity Regulatory Agency (ANEEL) and the National Telecommunications Agency (ANATEL) decided today to submit to society the Joint Resolution proposal to regulate the sharing of posts between telecommunications service providers and electricity distributors.
According to the proposal, the monthly reference amount for the use of one cable attachment point per power pole used is R$2.44, but this value will only be applied to resolve conflicts between telecommunications service providers and electricity distributors. The rule is the free negotiation between the parties to establish the price for using the distributors’ infrastructure.
The Resolution seeks to confer equally conditions for telecommunications service providers and avoid barriers to the entry of new competitors in the telecommunications market.
Energy distributors should create a public registry of poles occupancy, with information on agreements with telecommunications providers. When there is excess capacity, the distributor will be required to make a public offer of attachment points.
The proposal will receive contributions for 45 days in the portals of the agencies on the Internet and will be discussed at two open meetings on September 4 (São Paulo) and September 11 (Brasília).
