The Brazilian Electricity Regulatory Agency (Agência Nacional de Energia Elétrica – ANEEL) published Dispatch No. 2771 in the Official Gazette amending of R$ 18.9 million to R$ 18.6 million the amount of the fine imposed on Companhia Energética de Minas Gerais (Cemig D). The penalty was imposed after an inspection conducted in the period from 6/11 to 6/15/2012 to verify compliance by Cemig of procedures for data collection and calculation of the indicators of individual and collective continuity *(DIC and FIC) **(DEC and FEC) and achievement of financial compensation due to consumers by extrapolation of individual continuity indicators.
When there is transgression of the individual indicators, the distributor must financially compensate the consumer. The compensation is automatic and must be paid within two months after the month of calculation of the indicator (month in which there was interruption).
The inspection area of the Agency changed the fine following an appeal by Cemig D, but the value of penalty can still be modified after analysis by ANEEL’s Board during the public meeting.
