Hearing on sharing posts open until 9/19

The public hearing that aims to control the sharing of posts between providers of telecommunications and electricity distributors receives contributions from society until the 19th of September. The proposal will be discussed at two open meetings on September 4 (São Paulo) and September 11 (Brasília).

A joint resolution of the Brazilian Electricity Regulatory Agency (Agência Nacional de Energia Elétrica– ANEEL) and the National Telecommunications Agency (Agência Nacional de Telecomunicações – Anatel) has the objective of providing equal conditions to providers of telecommunications services and avoid barriers for the entry of new competitors in the telecommunications market.

For director rapporteur of the case at ANEEL, André Pepitone da Nóbrega, “the idea of regulation is to curb the market power of large service providers that use the structure of the poles of the electricity distribution network.”

According to the rapporteur, the structure of the regulation benefits society by facilitating access to various services through the efficient use of the structure of the distribution network, as well as contributing to urban planning, to prevent the installation of additional poles by telecommunications service providers.

The proposal provides a monthly reference of R$ 2.44 for the use a cable fixation point per post, to be applied only in the solution of conflicts between telecommunications providers and electricity distributors – because the rule is free negotiations for the use of the distributors’ infrastructure.

Moreover, the power concessionaries should create a public record of the occupations of the posts with information about contracts with telecommunications providers. When there is excess capacity, the distributor must make a public offer for fixation points. (JS/PG)
