Just in August, 700 municipalities in 21 states and the Federal District and the Union received R$ 119.56 million as compensation for use of Water Resources (CFURH – Compensação Financeira pela Utilização de Recursos Hídricos), while the transfer of R$ 49.6 million in royalties reached 346 municipalities in five states and the Federal District and the Union from January to August, a total of R$ 1.042 billion was distributed by CFURH and R$ 356.5 million in royalties.
Financial Compensation for Use of Water Resources for the Purpose of Generating Electricity – CF was established by the Federal Constitution of 1988 and it is a percentage that the hydroelectric concessionaires pay for the use of water resources.
The Brazilian Electricity Regulatory Agency (ANEEL – Agência Nacional de Energia Elétrica) manages the collection and distribution of resources among the beneficiaries: States, municipalities and governmental agencies of the Union.
45% of the resources are allocated to the municipalities affected by the reservoirs of hydroelectric power plants, while other states are entitled to 45%. The Union gets 10% of the total. Generators characterized as Small Hydropower Plants (SHP) are exempted from the payment of financial compensation.
The percentage of 10% of CF due to the Union is divided between the Ministry of Environment, Water Resources and the Amazônia Legal (3%); the Ministry of Mines and Energy (3%) and the National Fund for Scientific and Technological Development (4%), administered by the Ministry of Science and Technology. The percentage of 0.75% is passed on to the MMA for use in the implementation of the National Policy of Water Resources and the National Water Resources Management.
