Public Consultation on tariff review methodology for distributors is now open

The National Agency for Electricity opened the Public Consultation No. 11/2013 to discuss enhancements on the methodology of tariff review for the electricity distribution companies. The contribution period goes from 10/18 to 11/22.
 
Two technical notes were made available, as a basis for the development of the project. The Technical Note No. 452/2013, elaborated by the Superintendency of Economic Regulation (SRE), deals with general concepts of economic regulation (asymmetric information, incentive regulation and stability of rules), in addition to presenting reviews on specific topics such as WACC, X factor, operating costs, basis for remuneration and other revenues. On the other hand, the Technical Note No. 453/2013, jointly developed by the SRE and the Regulatory Superintendence of the Distribution Services (SRD), addresses the issue of non-technical losses and incentive mechanisms on quality. One of the highlights of the proposal is the elimination of the concept of tariff review cycle, so that the items that make up the tariff review process can evolve according to the dynamics and traits of each case. The end of the cycle concept also implies that there will always be a regulation approved and in place for the calculations of tariff revision, avoiding delays and postponed revisions.
 
During the period of Public Consultation, technical meetings will be held at the headquarters of ANEEL with three interest groups: representatives of consumers and consumer protection agencies (13/11), market analysts and investors (11/20) and representatives of distribution concessionaires (11/22).
 
The consultation will be followed by two more phases, whose topics will be discussed at a public hearing. The first will deal with the definition of the parameters to be used in the rate review process. The final phase will discuss the application of these parameters to obtain the results of the tariff review methodology.
 
The expectation is that the Agency's regulation resulting from this process will be approved in 2014 and will be applicable from 2015 onwards.
