Final version of the document permits the participation of the Cambuci and Barra do Pomba hydroelectric plants.

The relevant notices for the A-5 and A-3 new energy auction were published today (5/31) in the Official Federal Gazette. The full version of the notices and the models of the commercialization contracts will be available on the homepage www.aneel.gov.br, and in printed version at Brazilian Electricity Regulation Agency (Aneel) headquarters in Brasília. The documents were approved last Tuesday (5/29) by the Agency’s Board. The auctions, foreseen for next 26th, will negotiate electric energy to begin supply in 2012 (A-5) and 2010 (A-3).

The final version of the relevant notices includes the initial ceiling prices for energy, by source, defined by the Ministry of Mines and Energy. In the case of the A-5 auction, a value of R$ 126.00 per megawatt-hour (MWh) was established for water source enterprises and of R$ 141.00 per MWh for thermoelectric plants. At the A-3 auction, the reference price for water source energy is R$ 124.00 MWh and for thermal energy it is R$ 140.00 MWh.

Relevant notices 002/2007 and 001/2007, and the Contracts for Purchasing and Selling Electric Energy in a Regulated Environment (CCEARs) by quantity* (water source enterprises) and by availability** (other sources) can be consulted on the link: Espaço do Empreendedor/Editais de Geração. The CCEARS by quantity will have a duration of 30 years and the contracts by availability a duration of 15 years.

The auctions are geared towards new generation enterprises that have yet to be granted, expansion projects at existing plants and energy importation enterprises. Plants accredited by March 16, 2004 and projects that started commercial operations after January 1, 2000, and whose energy had not been contracted by March 16 of last year, can also participate, as per article 17 pf law # 10.848/2004. The two auctions should be the final opportunity for plants included in the latter case to be able to negotiate supply contracts such as new energy.

New hydroelectric plants – The final text of relevant notice 002/2007 (A-5) underwent changes to permit the inclusion of the Cambuci (50 MW) and Barra do Pomba (80 MW) hydroelectric plants, both in Rio de Janeiro. These enterprises will have their concessions in dispute during the first phase of the auction, but confirmation of the grant will be conditioned on negotiation of the energy during the second phase.

According to the timeline, the sellers of energy from enterprises accredited by the Energy Research Company (EPE) and buyers shall deposit the financial or proposal guarantees next 19th to participate in the auctions. The enterprises that negotiate energy will go through the post-qualification phase when they will need to present documents to prove legal and fiscal regularity, economic-financial stability and technical qualification.

The preliminary version of the relevant notices and the energy purchase and sale contracts was submitted to document public hearing from the 9th to the 18th of this month, when it received contributions from electric sector companies and associations. Among the suggestions included by Aneel in the final text of both documents is the exclusion of the demand for substance recomposition *** with new energy for cases of delays in starting commercial operation of the plant. The justification for this exclusion is that, according to current rules, eventual cost reductions in the purchase of cheaper energy could be passed on to the final user.
