Today (3/4), the Brazilian Electricity Regulatory Agency (Aneel) approved the preliminary versions for the bid notice and for other documents related to the reserve energy auction, specifically for contracting electric energy from biomass, projected for April 30, as per Ruling # 06/2008, of the Ministry of Mines and Energy (MME). This documentation will remain at the document public hearing process from tomorrow (3/5) to March 20 and will be available at www.aneel.gov.br, under Audiências/Consultas/Fórum.
As determined by Aneel, the Chamber for Electrical Energy Commercialization (CCEE) will operate the auction over the Internet. The objective is to commercialize biomass energy for delivery starting 2009 and 2010. Fifteen year contracts will be negotiated in the energy availability mode. The generation period will be as declared by the enterprise according to the sugarcane harvest production period.
As proposed in the hearing, reserve energy contracting will be formalized by the signing of the Reserve Energy Contract (REC) by the sellers and CCEE. The buyers (distributors, free and special consumers and self-producers) shall sign a Reserve Energy Use Contract (Conuer) with CCEE. Administrative, financial and tax costs in contract process structuring and management shall be shared proportionally among all National Interconnected System (SIN) consumers, including the free and special consumers and self-producers, though payment of the Reserve Energy Charge (EER), foreseen in Decree 6.353/2008.
The reserve energy acquired at auctions cannot constitute coverage for reselling energy and it shall be exclusively accounted for and paid on the CCEE’s Short-Term Market.
The public notice and the respective RECs shall consider what is set down in MME Ruling # 69/2008, which establishes auction systematics. The total amount of reserve energy to be contracted shall be defined by the Ministry, also according to Decree # 6.353/2008.

Reserve Energy is the energy used to increase the safety in supplying electric energy to the National Interconnected System from specially contracted plants for such a purpose.
