Approved the auction edict of 19 new transmission lines

The Brazilian Electricity Regulatory Agency (Aneel) proved today (03/25) in a meeting of the collegiate board the edict of the auction of concession of 19 new transmission lines and 21 substations in 12 states: Amapá, Amazonas, Bahia, Goiás, Mato Grosso, Minas Gerais, Pará, Paraná, Rio de Janeiro, Rio Grande do Sul, Santa Catarina and São Paulo. The lines, anticipated in the government’s planning, represent the addition of 3 thousand kilometers to the Basic Network of the National Interconnected System (SIN).

The edict will be published in the Diário Oficial da União (Official Daily Government Newspaper) next Monday (03/31), date in which it will be available at the link Licitações/Editais de Transmissão on the Agency’s internet page (www.aneel.gov.br). In 12 batches, the concessions of the enterprises will be auctioned on June 27, at 10 a.m., on the ground of the Stock market of Rio de Janeiro, in a public session guided by the São Paulo Stock Market (Bovespa).

The construction should be concluded in deadlines that vary between 15 and 36 months, from the signing of the concession contracts which seek the installation, operation and maintenance of the enterprises. The total investments are estimated at R$ 2.86 billion. The implementation of the enterprises will allow for the generation of 28.6 thousand direct jobs.

This coming April 8th, the clarifications about the instruction manual and auction procedures will be supplied in a meeting in Aneel’s auditorium in Brasília, from 3 p.m. to 5p.m. The chronogram establishes that the delivery of documents for pre-qualification will be on May 12th from 9 a.m. to 2 p.m. at Companhia Brasileira de Liquidação e Custódia (CBLC), on rua XV de Novembro, 275, in the capital of São Paulo. The guarantees should be deposited also at CBLC by 2 p.m. on June 26, the day before the auction. The signing of the concession contracts is anticipated for this October.

SE Joinvile – Ordinance nº 108, dated March 14, 2008, from the Ministry of Mines and Energy, determined for Aneel that the substation Joinvile Norte be authorized to Eletrosul. However, the Decree nº 6.402, posteriorly published, determines the promoting of a tender for this same enterprise. This way, fulfilling the principle of legality, the agency maintained the substation, of 230/138 kilovolts (kV), in batch I of the referred to auction. If the Decree is rectified, abolishing the SE Joinville’s obligation to bid, this enterprise will be excluded from batch I before the publication of the edict or in up to 15 days before the receiving of documents for pre-qualification.

Batch L – The edict approved today includes batch L, however until this moment the decree which authorizes the enterprise in the National Program of Privatization (PND) has not been published. This way, if the decree referred to is not published until this coming 31st, the batch will be removed from the edict. The tender of the enterprise is recommended in resolution nº 2/2008 by the National Council of Privatization (CND).

Rules – By the auction standards, those who offer the lowest tariff, or in other words, the lowest Allowed Annual Revenue (RAP) for the transmission service rendering will be declared the winner. Private and Public, national and international, isolated or in consortium, companies can participate in the auction as well as investment funds in participation registered with the Securities Commission (CVM). The companies that are not transmission leasers and the winning consortiums of the auctioned batches shall constitute a Specific Proposal Society (SPE) to sign the concession contract.
