Proposal regulates criteria for approval and registration of energy contracts

The bilateral contracts of purchase and sale of electric energy negotiated in the Free Commercialization Environment (ACL) by generators, commercializers and free consumers and the Contracts of Purchase of Encouraged Energy (CCEIs) among generators and special consumer will be dismissed from the presentation to Aneel, according to the proposal submitted to the public hearing by the next 30th. Available for consult at the electronic address www.aneel.gov.br, the minutes of the resolution regulate the criteria and procedures for information, registration, approval or homologation by the Agency of the purchase and sales contracts of electric energy among the market agent.

The document has the objective of disciplining the procedures referring to the sending of the contracts of commercialization of energy to Aneel, setting which contracts should be forwarded to the Agency and which will be homologated, approved, registered or simply informed by the regulator organ.

In relation to the Regulated Commercialization Environment (ACR), which shelters the contracts of purchase of energy negotiated by the distribution leasers through auctions, the demand of homologation by Aneel is maintained. The Agency will continue responsible also for the approval of the contracts of purchase of energy between companies in the same group, and for the approval of the minutes of the contracts of purchase of energy in the regulated environment in its different modalities (CCEARs, Adjustment Contracts, Energy Reserve Contracts).

As to the contracts celebrated in the Free Contracting Environment (ACL), the proposal intends to simplify the demands, without dismissing the control of relevant information about the transaction carried out in this environment. Such contracts, which are already registered in the Chamber of Commercialization of Electric Energy (CCEE), be just be informed to the Agency.

All types of transaction are, necessarily, registered at the CCEE, responsible for the accounting and financial liquidation of business carried out by the electric sector agents.
