Proposal of edict of auction of A-5 auction is in public hearing

The minutes of the edict 003/2008 and of contracts related to the auction of electricity of new enterprises of generation foreseen for August 28th of this year will be submitted to documental public hearing from today (06/25) until this coming July 9th. The auction, called ‘A-5’, is designated to the negotiation of contracts of electricity with the start of supply in January 2013.

The edict’s proposal does not include the auction reference prices, which will be defined opportunely by the Ministry of Mines and Energy (MME) and will certify the document’s final version to be approved by the Agency’s board of directors. MME shall publish, during the next days, the ordinances with the systematic and guidelines of the dispute.

The A-5 auction is directed towards projects of enlargement of existing mills, the enterprises of importing of energy and the new enterprises of generation of the National Interconnected System (SIN), which will have the respective sanctions of concession or authorization conditioned to the negotiation of energy in the dispute. At the auction energy will be auctioned that comes from three hydroelectric mills: Cambuci and Barra do Pomba (Rio de Janeiro) and Baixo Iguaçu (Paraná), concessions for which the interested entrepreneurs should compete in the first phase of the auction.

The buyers will be the electricity concession leasers who declared to MME their electricity purchase needs for 2013 by this past March 10th, and confirmed or corrected these declaration by April 29th of this year, according to MME Ordinances nº 83/2008 and nº 158/2008.

The auction will negotiate contracts of Commercialization of Energy in the Regulated Environment (CCEAR) of 30 years in the modality quantity* (hydraulic source enterprises), and 15 years for availability** (thermoelectric mills and other sources). A-5 is foreseen in Law nº 10.848/2004, in Decree nº 5.163/2004 and in MME Ordinance nº 331/2007.

*Contract for quantity –considers the sum of energy associated to the potency installed of the mill which is passive to contracting.
**Contract for availability – based on the possibility of generation of the enterprise starting from the existence of the source of energy. This source, in the case of thermoelectric mills, should be petroleum, natural gas and organic material residue products. In the case of wind mills, the wind and, solar mills, the sun.
