The final version of the edict of the 6th new energy auction forecast for August 19th, approved yesterday (07/15) by the Brazilian Electricity Regulatory Agency’s (Aneel) collegiate board is available starting today at the electronic address www.aneel.gov.br. The dispute date, defined previously as August 12th, was postponed to the 19th according to Ordinance nº 239/2008, by the Ministry of Mines and Energy (MME) published today (07/16) in the government’s official daily newspaper (Diário Oficial da União).
Called A-3, the auction will negotiate on the internet contracts of energy commercialization starting supply in January 2011. The ceiling price established by the MME and included in the edict will be R$ 150 per megawatt-hour (MWh).
The minutes of edict 02/2008 and of the electricity commercialization contracts were submitted to the documental public hearing this past June 11th to 25th. Besides the edict, the chronogram of the tender and the other documents related to the auction can be checked at the electronic address www.aneel.gov.br, on the link Espaço do Empreendedor/Licitações/Editais de Geração.
The dispute is directed towards new enterprises of generation not yet authorized and energy importing enterprises. Participating in this as buyers should be all the electricity distribution leasers that send to the Ministry of Mines and Energy (MME) their needs for purchasing electricity for the next three years, as disciplined by the ministry itself.
Two modalities of contracts of Commercialization of Electric Energy in the Regulated Environment (CCEARs): per quantity* of 30 years (enterprises of hydraulic source) and availability for ** 15 year (other sources).
The auction’s systematic is established in MME Ordinance nº 231/2008. The A-3 auction is foreseen in Law nº 10.848/2004, in Decree nº 5.163/2004 and in MME Ordinance nº 331/2007.
