Aneel releases enterprises able to deposit guarantees for reserve auction

The Brazilian Electricity Regulatory Agency’s (Aneel) Special Tender Commission released the list of 89 companies that can deposit guarantees to participate in the reserve energy auction, which will be exclusively for biomass this year. The auction is scheduled for next August 14, when reserve energy contracts will be negotiated over the Internet according to availability, valid for 15 years and with supply beginning in 2009 and 2010. The list of plants technically qualified by the Energy Research Company (EPE) included generator plants located in Minas Gerais, São Paulo, Piauí, Goiás, Mato Grosso do Sul, Mato Grosso and Alagoas. Participation in the reserve auction shall be confirmed by the companies next August 1, the date to register and allocate participation guarantees, from 10am to 5pm at the Transamerica Flat International Plaza, located at Rua Alameda Santos, no. 981, Cerqueira César district, São Paulo. The 89 companies shall offer nearly 6,400 megawatts (MW), whose initial Enterprise Classification Index (ICE), defined by the Ministry of Mines and Energy (MME), is R$ 61 per megawatt hour (R$/MWh). In order to calculate the value that will adequately remunerate the Fixed Income for each Physical Guarantee unit generated in these plants, the company must add the ICE value to the Variable Annual Income for its company.

Public or private, domestic or international companies can participate as sellers individually or in consortiums, as can Investment Fund Participations (IFP).

Reserve energy contracting will be formalized by signing the Reserve Energy Contract (REC) between the sellers and Electric Energy Commercialization Chamber (CCEE). Likewise, distributors, free and special consumers and self-producers (called consumer agents) shall adhere to the Reserve Energy Use Contract (Conuer).

Administrative, financial and tax costs in contract process structuring and management shall be shared proportionally among all National Interconnected System (SIN) consumers, including the free and special consumers and self-producers, through payment of the Reserve Energy Charge (EER), determined in Decree 6.353/2008.

The auction for contracting reserve energy is determined in Law 10.848/2004, in Decree no. 6353/2008 and in MME Administrative Rules 331/2007, 020/2008 and 069/2008.
