The undertakers solicited the extension in the period of the full compliance guarantee deposit

The extension requests for the full compliance guarantee contribution period of the A-5 Auction, made by the companies Espírito Santo Geradora de Energia S/A, Energética Capixaba S/A, Cosan Centroeste S/A Açúcar e Álcool and Águas Guariroba Ambiental Ltda. (leader of the MC2 consortiums), were rejected today (19/12) by Aneel’s board of directors, in a special meeting.

The undertakers solicited a 90-day extension as they alleged difficulties in the negotiation of the guarantees due to the international financial crisis. With the board’s decision, as established in the publication’s schedule, the next 26 is maintained for the full compliance guarantee deposit *, which to the A-5 auction corresponds to 5% of the undertaking’s investment amount. Together, the four companies must deposit around R$370.7 million referring to the 18 thermoelectric plants whose energy was negotiated in the contest. Those plants represent nearly 80% of the amount negotiated, not considering the energy deriving from the Baixo Iguaçu hydropower plan, also sold at this auction.

According to the proceeding’s reporting director, Joísa Campanher Dutra, ‘the arguments presented by the companies are insufficient to meet the lawsuit and the mere allegation of occurrence of ‘financial crisis’ is not enough to alter the rules of the game. Moreover, any alteration in the period compromises the necessary equality and stability of the rules established in this publication and in future auctions.’
