Public note”s draft for the first Transmission lines auction of 2009 is in a public hearing

The Brazilian Electricity Regulatory Agency (Aneel) approved today (02/17) the establishment of a documentary Public Hearing in order to obtain contributions to the public note proposal for the first transmission lines auction of 2009 (Auction no. 001/2009). The bid aims at the concession of 18 new transmission lines and nine substations, divided into 11 lots. The undertakings, set forth in the Brazilian Federal Government’s planning, represent a 2,338.2km growth to the Basic Network of the National Interconnected System (SIN). The new lines will be present in the states of Rio Grande do Sul, Mato Grosso, Rondônia, Acre, Paraíba, Alagoas, Rio Grande do Norte, São Paulo, Paraná and Goiás. The auction will be carried out at the Rio de Janeiro Stock Exchange, in a public session conducted by BM&F Bovespa on a date yet to be defined.

The documents related to the proposal will be available as of tomorrow (02/18) in the ‘A Aneel’ profile, on the link Audiências/Consultas/Fórum/Audiências ano 2009 of the website www.aneel.gov.br. Contributions can be sent until March 4 to the e-mail ap007_2009@aneel.gov.br. Suggestions will also be received via the fax no. Rules – The public note’s draft, presented in a public audience, presents several changes in comparison to the previous bids. For example, the possibility for the proposal warranty registration and contribution to be made via internet was included in the ones related to the bid’s taxonomy. Another suggestion in the draft is related to the investment’s estimated percentage to determine the full-compliance warranty, the proposal of which establishes that the amount be 5% of the total estimated investment for the undertaking and not 10%, as in the previous auctions.

From this auction on, according to the presented proposal, penalties, sanctions and the responsibilities of the winning applicant in the event of defaults between the contest period and the signature of the Concession Contract will be set forth in the public note. In previous bids, the public note determined the application of these rules accordingly to the Law 8.666/93,  the Bid Law. This measure will enable Aneel to, for instance, guarantee the applicants proposal if the winning party does not ratify its proposal, present the documents required for the licensing or the necessary documents for the receipt of the concession grant within the period and in the forms defined by the public note or present the full-compliance warranty.

For this auction, the stage inversion will be applied once more. It consists in the legal, technical, economic-financial and tax licensing after the auction’s completion. In the stage prior to the contest, the only requirements will be the registration documents and the confirmation of the interested parties’ participation by means of the deposit of the financial warranties required for the process.

Construction of the installations must be concluded within periods varying between 20 and 24 months, counted from the signature of the concession contracts, which have a 30-year validity, aiming at the undertakings’ installation, operation and maintenance. The investments total R$1.825 billion, according to estimates by the Empresa de Pesquisa Energética (EPE).
