Public note of the auction of 19 new transmission lines is approved

The Brazilian Electricity Regulatory Agency (Aneel) approved today (03/31), at a meeting of the College Board of directors, the public note of the concession auction of 19 new transmission lines and nine substations in 13 states: Acre, Bahia, Alagoas, Goiás, Mato Grosso, Minas Gerais, Paraíba, Paraná, Pernambuco, Rio Grande do Norte, Rio Grande do Sul, Rondônia, and São Paulo. The lines, which are expected in the government’s planning, represent a 2,400-kilometer increase in the Basic Network of the National Interconnected System (SIN).

The public note is going to be published next Wednesday (04/02) in the Brazilian Official Press, when it will be available on the link Espaço do empreendedor/Editais de Transmissão of the Agency’s website on the internet (www.aneel.gov.br). In 12 lots, undertaking concessions will be auctioned on May 8, at 10:00, at the Rio de Janeiro Stock Exchange, at a public hearing conducted by the São Paulo Stock Exchange (BM&F Bovespa).

The construction should be finished in periods which range between 18 and 24 months, after the signature of the concession contracts, which provide for the installation, operation and maintenance of the undertakings. Total investments are estimated to be of R$1.787 billion. The implementation of the undertakings will allow for the generation 28,600 direct jobs.

On April 9, clarifications on the instruction manual and auction procedures will be provided in a meeting at the Aneel auditorium, in Brasília, from 15:00 to 17:00. The schedule establishes that the registration and warranty contribution will be carried out on May 4, 5, and 6 via the online system and, while warranties without a digital certification with a escrow account are going to be received on May 6, from 9:00 to 14:00 at BM&F Bovespa, located on Rua XV de Novembro, 275, in São Paulo. Signature of the concession contracts is expected to be in October, this year.

Rules – According to the auction rules, the winners will be those that offer the lowest tariff, i.e., the lowest Allowed Annual Income (RAP) for the rendering of transmission services. State- and private-owned, national and foreign companies, isolated or in a consortium may participate in the auction as well as investment funds in shares that are registered in the Securities Commission (CVM). The companies which are not transmission concessionaires and consortiums selling auctioned lots must constitute a Specific Purpose Society (SPE) in order to sign the concession contract.

This is the first auction in which the proposal registration and warranty contribution may be made via Internet. Instructions will be published on Aneel’s website through a Material Note. BM&F Bovespa will confirm the warranty contribution and the validation.

Another innovation is the reduction of the estimated investment percentage to determine the amount of the full-compliance warranty. Its proposal establishes that the value corresponds to 5% of the total estimated investment for the undertaking, and not 10%, as in previous auctions.

At this auction, the stage inversion will be applied. It consists in the legal, technical, economical-financial and tax qualification, after the auction. In the stage which precedes the contest, only registration documents and the confirmation of the participation of the interested parties will be requested, via the deposit of financial warranties required in the process.
