Fonte: ANEELThe board of the National Electric Power Agency (Aneel) decided in an extraordinary meeting held today to (Apr/28) to recalculate the rate of the second Tariff Review of Companhia Energética de Pernambuco (Celpe). The rate was recalculated to comply with the decision of the Acting Judge of the 9th Federal Court of the Judiciary Section of the Federal District, Alaôr Piacini.
In the court order granted in Injunction impetrated by Celpe, which suspended the decision of the collegiate board of the Agency that certified the tariff of the distributor last 22nd of April, the judge determined that Aneel consider, in the calculation of this review, the financial components resulting from transfer of the last installment of the deferment of the last tariff review of the distributor (occurred in 2005) and the liability of the Extraordinary Tariff Review of 2004, which total R$ 197.7 million. Aneel will appeal from the decision, however, while the appeal is not judged, it must comply with the court decision.
The new rates calculated resulted in an average effect of 6.45%, with application as of tomorrow (Apr/29) for 2.8 million consumer units in 185 municipalities of Pernambuco and in the city of Pedra do Fogo, in Paraíba. With the recalculation, the application of the rate per consumption class was also changed. See in the table below:
