New technology will allow Internet access through energy network
The Aneel executive board approved today (08/25), at a public meeting, a resolution that sets the rules for the use of Power Line Communications (PLC) technology. The Regulation lays down the conditions for using the infrastructure of energy distribution companies to implement the system that allows data transmission through the distribution network.
The regulation limits the use of energy distribution networks for telecommunications, ensuring quality, reliability and adequate provision of energy services, creating economic incentives to share the system and ensuring low tariffs.
The PLC service provider should follow the technical standards of the distributor, the one provided in this Aneel Resolution and in the regulation of telecommunications services and use of radio frequencies of Anatel. The establishment and operation of PLC will not be allowed to compromise the quality of energy supply to consumers and in case of need for investment in the network, the cost will be responsibility of the telecommunication company.
The use of the technology enables new uses for the energy distribution networks, without the need for expansion or adequacy of the infrastructure already existing. The economy represents a cost saving to consumers who will benefit from the appropriation of part of the additional profits obtained through the sale of the distribution facility, for the benefit of the reasonableness of tariffs.
The Agency foresees that the calculation of the revenue obtained by the energy concessionaires from the rental of the wires for Internet companies will work for the reduction of energy tariffs, in terms of specific legislation established by Aneel. This criterion is already used in the rental of poles for conducting telephone cables.
Although it uses the same physical means (the energy distribution networks), the technology allows independent use of services and, therefore, concessionaires will also be able to use the infrastructure of the PLC service provider to meet their needs and interests.
By providing its distribution network, the concessionaire shall give wide publicity to a minimum of 60 days for expressions of interest. The statement should be made public for three days with information about the infrastructure and conditions for the use of energy distribution facilities in at least three newspapers, two of which must have national circulation. The choice of the service provider should be disclosed within 90 days after the request.
Applications registered in this period can only be refused due to the limitation og capacity, security, reliability, or violation of engineering requirements. In this case, the distributor must provide a reason for the refusal within 60 days after manifestation of the interested party.
