In reference to articles published in the newspaper Folha de S. Paulo on the 18th, 19th and 20th of October, the Brazilian Electricity Regulatory Agency (ANEEL) states:

• There was no error in the calculation of tariff increases. The process of updating pricing always followed rules and regulations, so there was no unfair advantage to concessionaires or consumers;

• The role of ANEEL comply with the legal provisions, in line with the legislation in force in the country and the contracts between companies and grantor;

ANEEL considers essential to promote improvements to their methodology and, in this perspective, identified in 2007, the need to improve the way of calculating the Settlement Account of Variation of Values and Items of Parcel A (CVA), provided in the Inter-ministerial Ordinance No. 25/2002;

• Upon realizing it, the Agency proposed improvements in order to avoid undesirable financial effects either to the consumer, or the distributors;

• The suggestions were adopted unanimously, in a public meeting, by the Board of Directors of ANEEL in October 2008 and sent for evaluation to the Ministry of Mines and Energy. The Agency maintains interaction with the ministry in order to improve the proposal.
