The Brazilian Electricity Regulatory Agency (ANEEL) announced that the Resolution. 61/2004 regulates the recovery of damaged equipment caused by disturbance in the electrical system. As for the norm, consumers connected to low voltage, such as residential, who might have had equipment damaged by the interruption of power supply checked last night (11/10) should seek the power distribution within 90 days to ask for compensation .
After reviewing the request, the distributor must, within 45 calendar days, refund the consumer if there is a relation between the damage and the disruption of the system. Within this period, the concessionaire has up to 10 days to inspect the equipment, up to 15 days after the inspection, to communicate the results of the consumer’s request and an additional 20 days to make the cash compensation, repair or replacement of equipment, if that is case. For appliances used in the preservation of perishable food, such as refrigerators and freezers, the inspection must occur within one business day.
