The National Energy Agency (Aneel) held, on Monday (7), a meeting to present the analysis of contributions to the Public Hearing 043/2009, concerning the draft amendment to the concession of the energy distributors. The goal is to improve the methodology for calculating tariffs to ensure the neutrality of the portion of the revenue of non-manageable costs (Parcel A), which has as component items such as power purchase and collection of fees.

The meeting was opened with a presentation, by the technical staff of the agency, of an analysis of the propositions received. Then, representatives of Sinergia/CUT of São Paulo, of the Fundação Pro Teste and of Federação das Indústrias do Estado de São Paulo spoke on the contributions sent to the Agency, including the possibility of change in the contract and inclusion of any compensation in the additive. The Board of Aneel said that the contractual change depends on the bilateral agreement and that any distortion generated by the methodology for calculating tariffs are already being evaluated in a specific administrative process, which will also be subject to public hearing.

The contributions and other documents relating to the Public Hearing 043/2009 can be consulted at the Agency’s website (www.aneel.gov.br), in the “Audiência/Consulta/Fórum”. The final analysis of the proposed additive shall be made by the elected board of Aneel in a public meeting.

The draft amendment to the concession contract was submitted to the Public Hearing, by exchange of documents, within November 6^th to 27^th, 2009.  Fifteen contributions were received from consumers, the distributors’ association and representatives of the Legislative Power and Federal agencies for consumer protection. In addition to the 63 distribution companies and their boards of consumers, anyone else responsible for the contributions were invited to the meeting this Monday.
