Aneel improves service rules to enable popular housing service

The National Energy Agency (Aneel) today approved new rules that improve Resolution No. 082/2004, concerning the service of power grids in urban lots and parcels located in residential areas of social and popular interest.

One new feature is to broaden the Resolution by defining the responsibilities of each agent and by extending to provide the condos, arranged in Laws No. 4591/1964 and No. 10406/2002, and the regularization of settlements located in an urban area, recently disciplined by Law No. 11977/2009, and the plots treated in Law No. 6766/1979. In that sense, it could be considered providing housing programs of social interest, such as the Programa Federal Minha Casa, Minha Vida.

Another change is that in the case of irregular settlements occupied by low-income population in the areas of social concern, the distributors are free to provide service on an interim basis. The purpose of this measure is to reduce the risk of accidents and damage to people, properties or premises of the electrical system, and combat the illegal use of energy. The attendance, however, depends on the express consent of the local government and the availability of energy and power by the distributor.

To reduce the costs of setting up the infrastructure for energy, especially for low-income communities, the licensee shall offer networking options and low cost standards. It is also envisaged the possibility of economic subsidies from government Federal, state or local programs or indirect government agencies, when responsible for implementation of land subdivision or regularization.

Prepayment - In attending the squatter settlements, in locations with little security to the service, with regular measurement difficulties, reading or delivery invoice, the customer may be subject to the prepayment, or an alternative solution, after the evaluation and the approval by Aneel. A pilot project to test the pre-payment mode is implemented by the Centrais Elétricas do Pará S/A (Celpa), which received, in March 2009, authorization from Aneel to evaluate alternatives for electrification and business management in two isolated communities in Araras and Santo Antônio, in the region of Ilha de Marajó (PA). Last November 4th, the Agency also authorized Amazonas Distribuidora de Energia S/A to implement the prepayment system to consumers in 13 isolated communities in Amazonas. In these places, the advance purchase of energy takes the form of credits acquired in their own communities. The electronic meter to be used is certified by Inmetro. All those consumer units are part of Programa Luz para Todos.

The new resolution will replace Resolution No. 82/2004. The matter was referred to public hearing (AP no. 026/2009) from July 2nd to August 5th, the date of the presential meeting. Forty-nine contributions were received from 19 parties, among them there are associations, distributors, Secretaria Nacional de Programas Urbanos do Ministério das Cidades, Sindicato dos Engenheiros de São Paulo and individuals.
