Aneel rules regulate the new Law on Social Rate of Energy

Procedures on how to update the list of candidates in the program shall be established by the Agency

Signed on Wednesday (01/20) by President Luiz Inácio Lula da Silva, a law that sets new rules for the Social Tariff of Energy (Law  No. 12212/2010)  indicates that ANEEL should regulate some of the innovations of the program.  The grant, which benefited all the units that consume up to 80 kWh per month, for example, will be restricted to families enrolled in the Unified Register for Social Programs of the Federal Government (CadÚnico) who have per capita family income of up to half the minimum wage.  Indigenous and maroons will also benefit from the discount.  Check  here who fits the new Social Tariff criteria.

The law states that Aneel sets out procedures so in up to two years the ratio of registered people is compatible with the new criteria.  It is the role of the regulator to set how the discount will be applied in multifamily dwellings, commonly known as slums, where one cannot install more than one meter.

Currently, Aneel technicians are preparing the resolutions that will govern the criteria established by law.  The requirement to discriminate on invoices the amounts of taxes and duties levied on the tariff is already regulated by resolution 166 of 2005 in Article 31.

The resolutions take effect following approval by the Board at the public meeting. Before that, the document is submitted to a hearing so that it is sponsored by society.
