The Board of the National Energy Agency (Aneel) approved on Tuesday (2nd), at the 4th Ordinary Public Meeting, additive to the concession contracts for utilities companies. The goal is to change the methodology for calculating the annual rate adjustment, to ensure the neutrality of the sector charges (check the box), preventing changes in market from generating inappropriate revenues either for concessionaires to for consumers.
The proposition approved warrants, in calculating prices, that the gain in revenue generated by market growth on sector charges will be fully passed on to the tariff moderation. ‘We came to that best proposition to balance the relationship between agents and consumers’, said the Director-General of ANEEL, Nelson Hübner.
The tariff adjustments of seven distributors authorized by the Agency at today’s meeting already took into account the new additive. To guarantee parity pricing, the impact of the additive in the rate of other distributors will be calculated over the years, on the date of their adjustments, taking into account changes in the market from February 2010.
The proposed amendment of the contracts was the subject of Public Hearing No. 043/2009 from November 6th to the 27th, 2009, in the form of exchange of documents. Sixteen contributions were received from consumers, association of distributors and representatives of the legislative bodies and consumer protection. On December 7th, Aneel held a public meeting to review the proposals received, with the expression of representatives of Sinergia/CUT from São Paulo, of the Pro Teste Foundation and the Federation of Industries of São Paulo. Representatives of distributors also attended meetings at the Agency to discuss the amendments proposed by the additive.
