The National Energy Agency (Aneel) fined concessionaire Light in R$ 9.5 million for the interruptions occurred in the months of November and December 2009 and January this year.
The inspection team of the Agency found deficiencies in maintenance and operation, equipment identified as almost inoperable and disability in the load management of underground networks of Rio de Janeiro, especially in neighborhoods like Leblon, Ipanema, Lagoa and Copacabana, besides downtown.
This inspection process was initiated in November last year to establish the frequent incidents in the power distribution network of the company. The deadline for the company to appeal the fine is ten days as from the receipt of the assessment notice, issued on February 17th this year.
Inspection
Aneel holds regular checks on distributors and broadcasters throughout the country. This activity follows an annual schedule and in the technical-commercial mode, it evaluates the maintenance of equipment, operations and customer service. In case of recurring events in a given concession area, a sharp inspection is deployed to determine the incidents. During the calculation, the company is notified to make the necessary clarifications, respecting the principle of legal defense.
If a failure in planning, operation or maintenance is found, the penalties range from warnings to fines of up to 1% of the company’s annual revenue, as set forth in Resolution No. 63/2004 of Aneel.
The penalty does not cease the obligation of the distributor to make the necessary corrections to solve the problem. If the company felt harmed by the tax assessment applied by the regulator, it may appeal to the Board of Aneel – which will assess the issue in a public meeting. The decision of the board is the last resort at the administrative level.
