Referring to the results of the review on the blackout occurred on November 10th, 2009, the National Energy Agency (Aneel) reports that there are available at the Agency’s website the documents associated with the monitoring process of Furnas Power Plants, whose infraction fine, of R$ 53.7 million, was sent to the company on Tuesday (the 23rd).
Aneel holds regular checks on generators, distributors and broadcasters throughout the country. This activity follows an annual schedule and in the technical-commercial mode it evaluates the maintenance of equipment, operations and customer service. In cases such as of the blackout of November 10th, a point inspection is open to establish the incidents. During the calculation, the company is notified to make the necessary clarifications, respecting the principle of contradictory and legal defense.
If a failure in the planning, operation or maintenance is found, the penalties range from warnings to fines of up to 2% of the company’s annual revenue, as required by item 10 of Law 9427/1996, regulated by Resolution No. 63/2004 of Aneel. The penalty does not end the obligation of the agent to make the necessary corrections to correct the problem. The company can appeal the penalty to the board of Aneel – which will evaluate resource in a public meeting. The decision of the board is ultimately at the administrative level.
