Over 700 km of transmission lines and 11 substations will enhance the core network as from 2012. The projects, divided into nine lots, will be auctioned on June 11th, at 10am, at the headquarters of the BM & F Bovespa in São Paulo. The rules of the event listed in the Auction of Transmission No. 001/2010, approved today (05/11) at the 17th Public Meeting of the Board of the National Energy Agency (ANEEL), organizer of the auction by delegation from the Ministry of Mines and Energy (MME).
The facilities are provided in the Transmission Expansion Program, prepared by the Energy Research Company (EPE) and were evaluated for their technical and economic feasibility as the best alternative for meeting the regions of Brazil. The works to be implemented in São Paulo, Rio Grande do Sul, Pará, Maranhão, Mato Grosso, Bahia and Alagoas, will demand investments of R$ 700 million, with generation of 3,450 direct jobs. The announcement will be available as from tomorrow (05/12) on the ANEEL website (www.aneel.gov.br) in Espaço do Empreendedor, at the link Editais de Transmissão 2010. The clarification of the instructions and procedures of the auction may be obtained at a meeting to be held on 05/18, from 3PM to 5PM, at the headquarters of ANEEL. The deadline for clarification about the announcement is 05/28. Interested parties may visit existing facilities related to the undertaking, according to the rules of the announcement. The deadline for request of visits will end on June 4th.
Private corporations with foreign or national rights, either alone or intercropped, and Investment Funds (FIP), also alone or intercropped with other funds or legal entities under private law, will be allowed to participate in the auction. Registration for the auction, sponsored by the National Energy Agency (ANEEL), as delegated by the Ministry of Mines and Energy (MME), the must be done through the online system, from 8AM on June 8th, to 2PM on June 9th.
The contribution of Proposal Guarantees, worth 1% of investment value estimated by ANEEL can be done from 9AM on June 7th to 5PM on June 9t. The two procedures may be done through the Internet, according to rules of the Announcement. On Thursday, June 10th, the Special Bidding Commission (CEL) of the auction will release on the Internet (at the same address as the Announcement) the list of proposers eligible to participate in the auction.
Systematic Auction – The financial proposal with the value of the Allowed Annual Revenue (RAP)* for each lot must be submitted by the participant in a sealed envelope. If the difference between the lowest bid and other bids exceed 5%, the lowest bidder wins the bid. If the difference is less than or equal to 5% or if there is a tie among the lowest bids, the auction proceeds, with successive moves made loudly. The director of the auction session may set minimum values to be provided between a bid and another. Bidder submitting the lowest value wins. In case no bidder makes a move loudly, the winner will be that who has submitted the lowest amount per envelope. If there is a tie in values shown by the envelope without submission of loud moves, the winner will be determined by lottery promoted by the director of the session.
Phase Inversion – As the auction is made by phase inversion, the delivery of legal documents for technical, economic, financial and tax clearance of winning bidders will happen after the event.
Loyal Compliance Guarantee – the Loyal Compliance Guarantee is contributed by the winners of the auction, replacing the previous guarantee. It corresponds to 5% of investment value and should be contributed up to two days before the signing of the concession contract.
Estimated schedule – Winners must deliver, on June 18th, the documents for the clearance stage. The result of the auction and the adjudication of the result are planned for July 27th. After the adjudication, the grant decrees will be published in the Official Journal of the Union. Concession contracts should be signed up to 20 days after the convocation.

* Annual Revenue Allowed: is the annual revenue that the broadcaster will be entitled for the provision of public service of broadcasting to users, as from the start of the operations of the facility. Its value is that obtained as a result of the auction, with annual update by the Wide Consumer Price Index (IPCA) of the Brazilian Institute of Geography and Statistics (IBGE) and a review once every five years under a concession contract.
