Transmission concessions Will be disputed by 19 companies and one consortium

Nineteen companies from Brazil and Spain and one consortium formed by three entrepreneurs, of which one is of Portuguese origin, are going to dispute Transmission Auction nº. 001/2010 for the concession of nine lots composed by four transmission lines and 11 substations. The event, promoted by the Brazilian Electricity Regulatory Agency (Agência Nacional de Energia Elétrica – Aneel), takes place tomorrow, Friday (06/11), at 10 a.m., at BM&F Bovespa, in São Paulo. The Proposal Guarantee value is equivalent to 1% of the investment estimated by ANEEL. Four transmission lines with a total extension of 708 kilometers (Km) and 11 substations will be tendered. The enterprises will be implanted in seven states: São Paulo, Rio Grande do Sul, Pará, Maranhão, Mato Grosso, Alagoas and Bahia. One of the lines, LT Araraquara 2–Taubaté, will allow for the complete outflow of energy coming from the Rio Madeira Hydroelectric Complex plants to the main Southeast load centers.

The investment expectation is around R$700 million, with the generation of 3,450 direct jobs. The projects will reinforce the basic network of the National Interconnected System (Sistema Interligado Nacional -SIN) starting in 2012, with the exception of the Pólo Substation, in Camaçari (BA), which should go into commercial operation six months before.

The auction rules are foreseen in the Edict available on Aneel’s electronic page (www.aneel.gov.br), in Entrepreneur’s Space and Transmission Edicts 2010. The event will be won by the companies that offer the lowest allowed Annual Revenue (Receita Anual Permitida – RAP)* per lot in relation to the value stipulated by the Agency.

Auction Systematic – The financial proposal with the Allowed Annual Revenue Value for each lot should be presented by the participant in a sealed envelope. If the difference between the lowest offer and the other offers is greater than 5%, the proponent of the lowest proposal wins. If the difference is lesser than or equal to 5% or if there is a tie between the lowest offers, the auction continues, with successive bids made by speaker phone. The auction session director may set minimum values to be offered between one bid and the next. The proponent who presents the lowest value will win. In the case of no proponent bidding by speaker phone, the winner will be the one who presented the lowest value in an envelope. If there is a tie of the values presented by envelope without the presentation of speaker phone bids, the winner will be determined by a drawing promoted by the session director.

Phase Inversion – Since the auction is by phase inversion, the delivery of documents for judicial, technical, economic-financial and fiscal qualification by the winning proponents takes place after the event.

Loyal Fulfillment Guarantee – The Loyal Fulfillment Guarantee is contributed by the auction winners, in substitution of the previous guarantee. It corresponds to 5% of the investment value and should be contributed up to two days after the signing of the concession contract.

Estimated Chronogram – The winners shall deliver, on June 18, the documents for the qualification phase, which results should be ready on June 25. The auction results and the adjudication of the result are predicted for July 27. After the adjudication, the grant decrees will be published in the official daily Government Newspaper [Diário Oficial da União]. The concession contracts should be signed up to 20 days after the summoning.
