Resolution 414: see what will be in force in March

Some new deadlines of Normative Resolution 414/2010, which addresses the electric power consumer’s rights and obligations, will be in force in March.The regulation that establishes the conditions for the electric power supply, was published by the Brazilian OfficialRecord (DOU) on September 15, 2010, with improvements in the relation between the consumer and the power electric distributor.

The reduction in the connection deadline will be valid to residential consumer units in urban areas and the industrial consumer. For residences, the connection may be done within two business days vs. former three business days. For industrial consumers, the order should be executed within seven business days, and not within 10 business days anymore. For reconnections in urban areas, the deadline will be reduced from 48 hours to 24 hours, also starting on March 1st.

Also starting on March 1st, the installed load increase up to 50 kW, with no phase increase, will be a free service to consumers already connected to the system. In addition, the new regulation disentangles the contract termination from the debt settlement.
Other considerations will be in force on March 15. One of them is the required creation of in-person customer centers in all cities covered by the concession area of each company. The implementation is gradual, according to the city size. Cities with over 10 thousand consumer units may have customer center after March 15. The customer centers in cities with 2 to 10 thousand consumer units may be available by June 15, while in cities with less than 2 thousand consumer units, the centers may be available after September 15, 2011.

Another change in effect on March 15 is related to the interruption in electric power supply due to unpaid bill – the payment should be done only during business hours. After the overdue bill has aged more than 90 days, the interruption should not be justified anymore (the supply will be interrupted within 90 days after the delay acknowledgement), unless the bills after that are settled. These alterations will be in effect on March 15.

Also on March 15, the distributors should adopt the standardized model of the Term of Occurrence and Inspection (TOI), as stipulated in Resolution 414, to ensure isonomy and standardize the installation assessment criteria.

The minimum rate, referred to as availability cost, will have some changes on March 15: the payment will be proportional to the contract termination date and no charges will be made in cycles after the supply interruption (if any). They minimum rate payment used to be in full, regardless of the contract termination. (DB/GL)
