Agency regulates change in Fuel Consumption Bill calculation

 The directorate of the Brazilian Electricity Regulatory Agency (ANEEL) approved today (2/22) a normative resolution to regulate Law no.12.111/2009 and Decree no. 7.246/10, which deal with electric energy production costs in isolated systems* and establish procedures on the Fuel Consumption Bill (CCC)**.

  The CCC is a charge that subsidizes the purchase of fuels used to generate energy at thermoelectric plants for isolated systems, mainly located in the north of the country.The fuel cost is collected in monthly installments by the distributors, transmitters and distribution service permissionaires.This charge, paid by all energy consumers in the country, is one of the items that comprise electric energy tariffs.The CCC was created by Law no.5.899/1973, but amended by Law no.12.111/2009.

  With the new resolution, the bill will begin to reimburse total expenses on energy production for isolated systems, which includes, besides the fuel used in thermoelectric generation, the costs for purchasing additional energy, own generation and charges and taxes not recovered by the distributors.Before, only the fuel cost was reimbursable.

  With the regulation, the energy will be contracted by the distributors through a tender and the CCC’s effect will no longer depend on the interconnection of isolated systems but rather on energy purchase contract periods.

  Other changes have to do with how to charge the bill.Eletrobras will have until October 31 of this year to send the CCC's Annual Cost Plan to ANEEL.This plan contains an indicative value that will be submitted for Agency approval in 2012.

In order to calculate CCC value this year, ANEEL will hold a still unscheduled public consultation.CCC unit costs per distributer to be included in the tariff readjustment and review processes for each concessionaire will be decided after the consultation.

  The financial impact of the new changes has yet to be estimated by ANEEL.

  The public hearing on the law’s regulation was held October 27 to November 22, 2010, with an in-person session on November 17.A total of 135 contributions from 20 institutions were received during the hearing.
