Norm on assigning a reserve enters discussion between plants and biomass

The regulation proposal that establishes guidelines for assigning energy and reserves between plants and biomass with Reserve Energy Contracts (CER) begins its public hearing process tomorrow (2/24) and contributions can be sent until March 25.

A rough draft of the norm elaborated by the Brazilian Electricity Regulatory Agency (ANEEL) also stipulates a penalty for those enterprises that do not begin commercial operations or whose plants are unavailable, as per Decree 6.353/2008.

The penalty for insufficient reserves can be characterized by the mismatch between the beginning of the plant’s commercial operations and the projected date at the moment of authorization and also for the delay in beginning commercial generation due to the degrading of the physical guarantee.The form for determining and charging the penalty shall be performed within the ambit of financial settlement related to contracting reserve energy.

In the norm under discussion, ANEEL also proposes that the assigning of energy between these plants may be through energy and an equivalent in reserves, or energy alone.According to the draft, this assigning shall be accounted for by the Chamber of Electrical Energy Commercialization (CCEE), within the ambit of the short-term market.
