The Brazilian Electricity Regulatory Agency (ANEEL) is in the final study phase for the proposal for regulating the contracting of distribution network use by self-producers* and independent producers** that use a single connection point to consume or inject energy.The topic will be included in the agenda for the 11th Ordinary Public Meeting of the Board next April 5.
The regulation will standardize the charges for using the distribution system by generation agents who also use distribution systems to consume energy part of the year, such as sugarcane producers.With that, the Agency plugs the regulatory gap on the theme, which used to bill agents as generators or as consumers (or any other billing variation).
The technical note is available on the Public Hearing no. 009/2011page, which dealt with the matter. The proposal under analysis by the Board is practically the same as in the technical note, with the exception that it also makes it obligatory to adapt new and existing contracts up to 90 days after publication of the new resolution.
Public Consultation no. 009/2010 received 35 contributions from 12 agents.Five were accepted, five partially accepted, 20 not accepted and another five were considered not applicable.(FA/GL)
*Self-producer of electric energy
This is the individual or legal entity or companies gathered in a consortium that receive the concession or authorization to produce electric energy for their exclusive use.

**Independent producer of electric energy
Legal entity or consortium of companies owning the concession, permission or authorization to produce electric energy and to sell all or part of the energy produced at its own expense and risk.
