ANEEL denied the request by the Bertin Group to postpone the beginning of generation from its six thermoelectric plants (TEP) and the request for exemption from the obligation to cover contracted and non-generated energy (recompose the ballast) from these plants at the Chamber of Electrical Energy Commercialization (CCEE).The company claimed the dates for issuing documents referred to the auction edict were not observed by Public Authorities, which generated a seven and a half month delay in the works timetable.

The decision was taken at the Board’s Public Meeting held today (3/29). Director André Pepitone da Nóbrega, in his vote, argued that the edict’s text makes it very clear that the dates are estimated and provisional, and he further emphasized that the enterprise, by signing the energy commercialization contract, did not dispute the change in the installation timetable for the enterprises.

With this decision by the Agency, the company will have to proceed and recompose the ballast and pay the penalty set by the CCEE.In a future Public Meeting of the Board, ANEEL will deliberate on the notices of infraction issued by the inspection area for delays in the timetable for plant works.

The plants MC2 Feira de Santana, MC2 Dias Dávila 2,  MC2 Dias Dávila 1, MC2 Catu, MC2 Camaçari 1 and MC2 Senhor do Bonfim, energy sellers in auction A-3 of 2008, of a total of 611 average Megawatts should have started commercial operations this January 1.That energy is sufficient to supply a city the size of Brasília, with about two million inhabitants.(FA/GL)
