The new regulation on contracting the use of the distribution network for self-producers* independent producers and compounders** using a single connection point to consume or inject power was approved yesterday (05/05) in a public meeting of the board.
 
The regulation standardizes the collection of charges for use of the distribution system for power generation agents that also use distribution systems to consume energy during part of the year, such as sugarcane producers.
 
After 90 (ninety) days following the publication of the new resolution in the Official Gazette, these agents should state, in a single Contract of Use of the Distribution System (CUSD) and the Connection Agreement of the Distribution System (SSC), the amount of use as consumers and the amount of use as generating plants.
 
The monthly charges will be paid in two installments: one on the consumer unit and the other on the power generation plant. The installment related to the consumer unit will be billed based on standards already in force, based on the highest Amount of Use of the Distribution System (MUSD) contracted and the MUSD calculated. Exceptionally for rural and seasonal consumers, according to Decree 62.724/1968, billing will be performed between the highest MUSD measured 10% of the highest MUSD recorded in the previous 11 months.
 
The installment relating to the power generation station will bill only the amount of use as generator that exceeds what has already been paid as a consumer unit. Thus, the Agency ends the regulatory gap on the subject, which meant that agents were billed either as generators or as consumers (or another billing variant) makes the process of hiring more isonomic.
 
The subject was submitted to Public Consultation 009/2010 and received 35 contributions from 12 agents. Of these, five were accepted, five were partially accepted, 20 were not accepted, and another five were considered not applicable. (FA/GL)

*Electricity self-producer
A natural person or legal entity or a consortium of companies that receive a concession or authorization to produce electricity intended for self-consumption.

A legal entity or a consortium of companies that hold a concession, permit or authorization to produce electricity intended for trade of all or part of the electricity produced, on its own risk.
