To guide agents involved in the electricity sector as for the appropriate legal discovery of requests for prior approval, the National Energy Agency (ANEEL) announces on its website information on procedures for submitting applications and on the estimated time for resolution by the Agency.

The approvals relate to transactions performed by agents that require prior approval by ANEEL. They are mostly committed by the technical area, but some cases are submitted to the resolution of the ANEEL board.

We analyze economic and financial aspects of actions such as changing incorporation of companies, provision of guarantees, the contract between related parties, untying (transfer) of goods, import and export of energy, exploration activity and atypical transfer of corporate control.

The need for prior consent is established in the acts of delegation of officials, as well as in normatives possessed, and aims to investigate the administration of agents to preserve the economic and financial balance of the grants, as well as a lower rate. Failure to comply with the sending of subjects for prior approval may culminate in the punitive process subject to imposition of penalties in accordance with Normative Resolution No. 63 of 05/12/2004.
