ANEEL maintains penalties toward six thermal plants of Bertin group

The board of the National Energy Agency (ANEEL) has maintained a fine of approximately BRL 1.2 million to Bertin group for noncompliance with the timeline for installation of six thermal power plants (TPP) in Bahia.

The plants MC2 Feira de Santana, MC2 2 Dias Dávila 2, MC2 Dias Dávila 1, MC2 Catu, MC2 Camaçari I and MC2 Senhor do Bonfim were energy  sellers in the A-3 auction of 2008, which started commercial operation on January 1st this year to produce 611 average megawatts.  

The reports of the review of the Agency show that the works should be advanced with the completion of the electromechanical assembly of generating units of until December 31st, 2009. By the time of inspection, conducted in January 2010, there was no mobilization for the construction of the site or for the start of civil works, which characterized the failure of the first stage of the timeline.

At the meeting on 03/29, the Agency had already denied the request, by Bertin group, to postpone the start generation by of six thermal power plants (TPP) and the request for exemption from the obligation to cover the contracted but not generated energy (recomposition of ballast) of these plants in the Energy Commercialization Chamber (CCEE).

Fines must be paid within ten days as of the publication of the order of the Board in the Official Journal of the Union. The decision of the Agency wears out the possibility of an appeal by the companies at the administrative level. (FA/GL)
