Fines imposed on companies are held by the board of ANEEL

The National Energy Agency (ANEEL) reviewed last Tuesday (17) business resources related to fines imposed by the supervision of the Agency. In the first case, Furnas Centrais Elétricas S.A.received a fine of BRL 3,423,409.41 and the Board decided to retain the penalty. The reason was a disturbance on June 16, 2009, which led to an interruption of 480 megawatts (MW) of load od distributor AMPLA Energia e Serviços S.A., due to the shutdown of the bar of 138 kV of the Adrianópolis substation.

In the case of company Mega Energia Investimentos e Participações Ltda., the penalty was imposed for failure to meet the implementation schedule of Small Hydropower Plant – SHP Jamari. The fine, amounting to BRL 47,378.28, was retained by ANEEL.

CELESC Distribuição S.A., however, was penalized for not providing the Reports of the Commercial Department containing the total amount billed for the Emergency Capacity Charge – ECE, month by month, with taxes levied at the time of billing and other information, failing art. 31 of Law No. 8.987/1995 and the Fourth Sub-Clause of the Eighth Clause of Concession Contract No. 020/2001. In this case, the Agency maintained the fine of BRL 397,244.38.
