ANEEL approves contracts allowing the use of optical fibers to Telebrás

ANEEL approved, on Wednesday (25), the agreements allowing the use of optical fibers signed between Telecomunicações Brasileiras S/A (Telebras) and transmitters Furnas Centrais Elétricas S/A, Companhia Hidro Elétrica do São Francisco (Chesf) and Centrais Elétricas do Sul (Eletrosul), companies of group Centrais Elétricas do Brasil S/A (Eletrobras). Thus, Telebrás will have to pay a rent to transmitters by sharing networks.

The approval came after the Audit Court of the Union (TCU) consider the equality of the process and reiterate that the contracts could be signed. Moreover, there is, in Decree No. 7175/2010, forecast that "Telebrás can use the telecommunications assets owned or held by the Federal Public Administration, materialized through the federal transmitters." With the existence of the decree and the demonstration in favor of TCU, ANEEL approved the contracts under review since last February.

According to a statement released at the Telebrás website, the value of these contracts for 2011 is approximately BRL 3 million, equivalent to the rent of fiber optics installed in transmission lines. It was expected a grace period of six months to the beginning of recovery. Telebrás will pay BRL 931,400 to Eletronorte, BRL 1.3 million to Chesf and BRL 873,900 to Furnas. The contract with Eletrosul does not provide rent payment in 2011 because the company's network should only be used at the end of the year. All contracts are valid for 10 years.
