The procedures governing public meetings of the Board of the National Energy Agency (ANEEL) are in public hearing. The goal is to receive contributions to discuss, for example, the distribution of processes per connection and deliberation of issues collectively.
The idea is that a process will only be distributed by the connection to another process that is still pending on determination, being forbidden the connection to a matter appreciated by the Board. Moreover, if there is a need for redistribution process due to connection, it will be forwarded to the rapporteur of the first process, to preserve the principle of randomness.
Regarding the determination in block, it was identified processes that can be judged together, such as a declaration of public utility for purposes of establishing an administrative service and for expropriation of land, besides those that deal with transfers of control or of grants except in the case of a public utility, and for authorizations of Annual Revenue Allowed (RAP) for the transmission facilities.
The changes aim to meet the principle of expediency, without compromising other principles of administrative procedure, such as due legal process, advertising, impersonality, contradictory and full defense.
The general procedures relating to the deliberative meetings of the Board are in the Standard Organization of ANEEL No. 18, which was reviewed in 2008 through Normative Resolution No. 321.
