ANEEL amends decision and changes the deadline within the business obligation of plants of Bertin

The National Energy Agency (ANEEL) amended a decision at the public meeting on 03/29 this year, which denied the request by Bertin Group companies to extend the six early-generation power plants (TPP) and accepted, in part,, the application for reconsideration of the company, delaying the start date of the business obligations of MC2 companies to April 12, 2011. In March, the agency denied the request, but the group applied for reconsideration, effected today (28) at the public meeting of the board.

The group maintained the claim that the dates for the issuance of documents referred to in the auction notice were not observed by the Public Government, which would have caused delay of seven and a half months in the schedule of works and that there were previous ones in the case of the Agency.  

The rapporteur of the case, director Romeo Rufino, reiterated the arguments that led to the decision taken, but directors Julian Coelho, Edvaldo Santana and Andrew Pepitone diverged from the rapporteur and voted in favor of excluding the 101 days, acknowledging the delay in the Public Government issuance of grant.

Thus, the duration of the obligation of the entrepreneur with the business Commercialization Chamber (CCEE) was extended from 01/01/2011 to 04/12/2011.

The fines imposed by the Agency, of approximately BRL 1.2 million, for failure to schedule the installation of six thermal power plants (TPP) are maintained.

Plants MC2 Feira de Santana, MC2 Dias Dávila 2, MC2 Dias Dávila 1, MC2 Catu, MC2 Camaçari 1 and MC2Senhor do Bonfim, energy traders in the A-3 auction of 2008, a total of 611 average megawatts, should have entered into commercial operation on January 1 this year. This energy is enough to power a city like Brasilia, with about two million inhabitants. (FA/DB)
