The notice of the Generation Auction No. 02/2011 A-3* was approved this afternoon (07/18) during the 4th Public Ordinary Meeting of the Board of the National Energy Agency (ANEEL). The event will be held on August 17 for the hiring of new power generation projects of hydroelectric, wind and biomass to fired or natural gas sources with supply beginning as from March 1, 2014.
The auction will be conducted over the Internet, with the operationalization of the House of Energy Commercialization (CCEE), in São Paulo. The electricity generated will be subject to Energy Trading Contract in the Regulated Environment (CCEAR), in terms of availability and amount of energy.
The Initial Price of Product Availability will be BRL 139.00/MWh, while the SP Product Quantity is BRL 139.00/MWh and the Reference Price of the HPP Jirau-Ampliação will be BRL 102.00/MWh. Finally, the Reference Price of other hydropower projects will be BRL 139.00/MWh.
The document follows the guidelines published in Ordinances No. 113/2011, No. 160/2011 and No. 289/2011 of the Ministry of Mines and Energy (MME). The system was defined in the MME Ordinance No. 299/2011.
An important change to the notices of the last generation auction (No. 04/2010 and No. 07/2010) was the upgrading of the text to better clarify the participation of foreign companies. This participation may be given alone or in partnership, with leadership exerted by a Brazilian company. Foreign companies that have participated in isolation and that will become winners in the auction should create a Special Purpose Company (SPC), under Brazilian law, to receive a grant of authorization.
In relation to the guarantees of participation and faithful performance, there was modification of the terms of contribution to renewal and restoration, which have, respectively, from 15 days and 5 days to 30 days before the expiration of each one.
The energy contracts were significant changes in order to give greater clarity to the obligations of the parties, buyers (retailers) and sellers (generators).
The notice must be published in the Official Journal on Tuesday (07/19). Documents relating to the auction will be available on the ANEEL website (www.aneel.gov.br), in Entrepreneur Space, Generation Notices. (AP / GL / DB)
*As the date of commencement of energy supply will take place in 2014 (three years from now), the auction is called A-3. The early contests where the supply takes place in five years are classified as A-5.
