Regulation disciplines hiring in international interconnection facilities

The board of the National Energy Agency (ANEEL) approved on Tuesday (07/26) in a public meeting, the publication of the Regulation laying down provisions relating to transmission facilities of electric energy to international interconnections that connect to the Basic Network of the National Interconnected System (SIN). 

These interconnections are used for the import and export of energy between Brazil and neighboring countries such as Uruguay and Argentina. The method of funding this type of installation, set by Law no. 12.111/2009, states that the user of the interconnection pays rate additional for specific use. Other basic network users remain with the entire cost of the facilities at times when there are no revenue streams when there are no import and export of electricity. 

ANEEL, according to Decree No. 7.246/2010 is responsible for rules regarding the hiring of service, specifically for determining the permitted annual revenues (RAP)* of the premises, by calculating the additional usage charge and the establishment of specific access rules and of the transmission service standard. 

The Regulation adopted characterizes and classifies facilities for international interconnections, lays down the establishment of the RAP, the rules for hiring the use and method of calculating the additional rates for specific use; the conditions for assimilation of facilities and the general provisions of service, about the quality, measurement and electrical losses. 

According to Law no. 9074/1995, with the wording of Law no. 12.111/2009, the process of assimilation that provides facilities for international interconnection, granted until 12/31/2010, the dealers are treated as public service of transmission participating in public bidding. 

The rule also provides that the calculation of equivalent lines of RAP are made ​​from the base remuneration of these facilities, the use of weighted average capital cost (WACC) established for the periodic review cycle of the revenue of the transmission concessionaires, effective on the date of assimilation, and for the use of the operating costs established for the periodic review cycle of the revenue of the transmission concessionaires, effective on the date of assimilation.
