ANEEL approves a distinction between reinforcements and improvements to transmission facilities

The National Energy Agency (ANEEL) approved a resolution to establish the normative differences between improvement and reinforcement of transmission facilities under the responsibility of transmitters. The Regulation replacing Resolution No. 158/2005 was in public hearing from 03/31 to 05/03 this year. 

The decision by the Agency Board on Tuesday (07/26) was supported by studies conducted by the technical areas of the Agency, which identified the need to clarify the distinction between improvements and reinforcements to induce greater efficiency in their implementation, and also to improve the clarity on how to pay and the responsibility of the concessionaire for each type of work. 

With the new resolution. there will be the distinction of the two types of work according to the need to maintain or enhance the service provided. Thus, when the objective is the maintenance of public service, the intervention should be classified as an improvement. When increasing the target service, it is classified as reinforcement. All reinforcements must be authorized by ANEEL. 

Previously, Resolution No. 158/2005, established that the National System Operator (ONS), should submit to ANEEL, annually, along with the Expansions and Reinforcements Plan (PAR), the Plan for Modernization of Systemic Interest (PMIS), a document that relates interventions (some types of improvements and some types of reinforcements) in systemic interest facilities. 

Both documents contain indications of reinforcements, which led to the unwanted situation of a certain large-sized undertaking (amount or authorized) having its full operation prevented by interventions in the same small region, only later indicated and authorized. 

The new regulation provides that all reinforcements are indicated by the ONS in the PAR to be submitted to the Ministry of Mines and Energy (MME). Thus, the Ministry will draw up the grant plan of the transmission to the determination of which facilities must be available and which bid will be increased by avoiding the existence of reinforcement at different levels. 

Additionally, the ONS must submit annually the Facility Modernization Plan (IMP) to ANEEL. In the PMI, there will be interventions classified as improvements in transmission facilities under the responsibility of transmitters, as well as interventions to be implemented by distributors in facilities under their responsibility and the interventions to be implemented by generators in facilities under its responsibility. 

The PAR and the PMI have a horizon of three years, comprising the period between the first and the third year following the year for preparing the plans.
